PRIVACY POLICY

Th3Circle LLC ("we", "us", "our") respects your privacy. This policy explains what data we collect, how we use it, and your rights.

1. INFORMATION WE COLLECT

Account Information: When you sign up, we collect your email address, name, and (for creators) payment information via Stripe.

Fan Data: When you join a creator's circle, we collect your email, name, country, state, and optional birthday.

Usage Data: We collect information about how you use the platform, including pages visited, features used, XP earned, and messages sent.

Device Data: We may collect browser type, device type, and IP address for security and analytics purposes.

2. HOW WE USE YOUR DATA

• To provide and maintain the platform
• To process payments via Stripe
• To send transactional emails (welcome emails, blasts, notifications)
• To calculate XP, rankings, and achievements
• To enforce our Terms of Service and content moderation policies
• To improve the platform and develop new features

3. DATA SHARING

• With Creators: Fan data (name, email, tier, XP) is shared with the creator whose circle you joined.
• With Stripe: Payment data is processed by Stripe. See Stripe's Privacy Policy.
• With Resend (Email Delivery): Email addresses are processed by Resend for email delivery (managed by the platform — creators do not need a Resend account). See Resend's Privacy Policy.
• We do not sell your personal data to third parties.
• We do not share data with advertisers (tracking pixels are set by individual creators on their join pages).

4. THIRD-PARTY SERVICES & SDKs

Th3Circle integrates with the following third-party services. Each has its own privacy policy:

• Supabase — Database, authentication, and real-time features. Privacy Policy
• Stripe — Payment processing for subscriptions, merch, and tickets. Privacy Policy
• Resend — Transactional and marketing email delivery (managed by the platform). Privacy Policy
• Netlify — Hosting and serverless functions. Privacy Policy
• Google Fonts — Font delivery (no tracking cookies). Privacy Policy

Creators may optionally add tracking pixels (Facebook, TikTok, Google Analytics, Snapchat) to their join pages. These are controlled by the individual creator, not by Th3Circle.

5. COOKIES & LOCAL STORAGE

We use localStorage and sessionStorage for session management, preferences, and analytics opt-in/out. We do not use third-party tracking cookies. You can manage your analytics preferences in your Profile settings under "Data & Privacy."

6. DATA RETENTION

We retain your data for as long as your account is active. If you request deletion, we will remove your personal data within 30 days, except where required by law.

7. YOUR RIGHTS

• Access: You can request a copy of your data (creators can export via the dashboard).
• Correction: You can update your profile information at any time.
• Deletion: You can request account deletion by contacting us.
• Portability: Creators can export all their data in JSON or CSV format from Settings.
• Opt-out: You can unsubscribe from marketing emails using the unsubscribe link in each email.

8. CHILDREN'S PRIVACY (COPPA)

Th3Circle requires users to be at least 13 years old. We do not knowingly collect data from children under 13. If we discover we have collected data from a child under 13, we will delete it promptly.

9. SECURITY

We use industry-standard security measures including:

• HTTPS encryption on all pages
• Supabase Row Level Security (RLS) on all database tables
• Passwords hashed via Supabase Auth (bcrypt)
• Two-factor authentication (2FA) available for creator accounts
• Content moderation with automated filtering

10. DATA BREACH NOTIFICATION

In the event of a data breach that affects your personal information, we will notify affected users via email within 72 hours of discovery. We will also notify relevant authorities as required by applicable law. To report a security vulnerability, contact security@th3circle.app.

11. CALIFORNIA RESIDENTS (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

• Right to Know: You can request what personal information we collect, use, and disclose.
• Right to Delete: You can request deletion of your personal information.
• Right to Opt-Out: We do not sell your personal information. If this changes, we will provide a "Do Not Sell My Personal Information" option.
• Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

12. EU/EEA RESIDENTS (GDPR)

If you are in the European Union or European Economic Area, you have rights under the General Data Protection Regulation (GDPR):

• Legal Basis: We process your data based on consent (account creation), contract performance (providing the service), and legitimate interest (security, fraud prevention).
• Right to Access: Request a copy of your personal data.
• Right to Rectification: Correct inaccurate data.
• Right to Erasure: Request deletion of your data.
• Right to Restrict Processing: Limit how we use your data.
• Right to Data Portability: Receive your data in a machine-readable format.
• Right to Object: Object to processing based on legitimate interest.
• Right to Withdraw Consent: Withdraw consent at any time via your profile settings.

13. DO NOT TRACK

Th3Circle does not currently respond to "Do Not Track" (DNT) browser signals. However, you can manage your analytics preferences in your profile settings under "Data & Privacy" or through the cookie consent banner.

14. INTERNATIONAL USERS

Th3Circle is hosted in the United States. By using the platform, you consent to the transfer and processing of your data in the US. We take appropriate safeguards to protect your data during international transfers.

15. CHANGES TO THIS POLICY

We may update this policy at any time. We will notify you of significant changes via email or platform notification at least 30 days before changes take effect.
