DMCA & COPYRIGHT POLICY

Th3Circle respects the intellectual property rights of others and expects all users to do the same. This policy outlines how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

1. REPORTING COPYRIGHT INFRINGEMENT

If you believe that content on Th3Circle infringes your copyright, you may submit a DMCA takedown notice containing the following information:

1. Your full legal name and contact information (email, phone, mailing address).
2. A description of the copyrighted work you claim has been infringed.
3. The specific URL(s) or location of the infringing material on Th3Circle.
4. A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
5. A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
6. Your physical or electronic signature.

2. HOW WE RESPOND

• We will review all valid DMCA notices within 48 hours of receipt.
• If the notice is valid, we will remove or disable access to the infringing material promptly.
• We will notify the creator/user who posted the content and provide them a copy of the takedown notice.
• Repeat infringers may have their accounts suspended or terminated.

3. COUNTER-NOTIFICATION

If you believe your content was removed in error, you may file a counter-notification containing:

1. Your name, address, phone number, and email address.
2. Identification of the material that was removed and its original location.
3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
4. Your consent to the jurisdiction of the federal court in your district.
5. Your physical or electronic signature.

Counter-notifications should be sent to dmca@th3circle.app with the subject line "DMCA Counter-Notification".

4. RESTORATION OF CONTENT

If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content.

5. REPEAT INFRINGERS

Th3Circle maintains a policy of terminating accounts of users who are repeat copyright infringers. Specifically:

• First offense: Content removal and warning.
• Second offense: Content removal and 30-day suspension.
• Third offense: Permanent account termination.

6. CREATOR RESPONSIBILITY

Creators on Th3Circle are solely responsible for ensuring they have the rights to all content they upload, including but not limited to:

• Music, audio files, and beats
• Images, photos, and artwork
• Videos and multimedia content
• Written content and documents
• Merchandise designs and product images

Uploading content you do not own or have a license to use is a violation of our Terms of Service and may result in account termination.

7. FAIR USE

Th3Circle acknowledges that certain uses of copyrighted material may constitute fair use under Section 107 of the Copyright Act. We consider fair use claims on a case-by-case basis.
